Ivanka and her brother were first called by James’ office in an investigation into their father’s fraud trial last year, in which prosecutors said the Trump Organization had intentionally misrepresented financial information in order to obtain favorable loans and other deals for more than a decade.

The siblings quickly challenged the matter in court, claiming that any information her team gained could be unfairly used in a separate but parallel criminal investigation run by the Manhattan District Attorney’s Office.

But on Thursday, Engoron ruled “The existence of a criminal investigation does not preclude the civil discovery of relevant facts, in which one of the parties may exercise a privilege against self-incrimination.”

This ruling means James will be able to bring a civil case against Trump using the affidavit if evidence of wrongdoing is found. She was unable to file criminal charges due to the nature of the investigation she conducted.

“Once again, the courts have ruled that Donald Trump must comply with our legal investigation into his financial dealings,” James said in a statement following the decision.

Meanwhile, the criminal investigation, which had begun under former District Attorney Cyrus Vance, has lost momentum in recent months after being taken over by new DA Alvin Bragg.

Bragg said in a statement last month that the investigation was still ongoing but did not provide many details, if any, about the progress made. A grand jury imposed on the investigation expired at the end of April without any public attempts to extend it.

Trump has on numerous occasions dismissed both investigations as a “witch hunt,” and has mocked James herself as a “racist” in recent statements about her investigation.

But in February, Engoron said the Trump trio’s argument that testifying in the James investigation would violate his right not to incriminate himself in the criminal investigation is completely false.

Their claim, he wrote, “ignores the salient fact that they have an absolute right to refuse to answer questions that they claim might incriminate them.”

While the former president stepped back from running the company before coming to the White House, his son, Donald Trump Jr. remains an executive vice president there.

Ivanka Trump left the company in 2017 to be a consultant in her father’s presidential administration alongside her husband, Jared Kushner.

His second son is also an executive at the Trump Organization – Eric Trump had already been forced to sit under oath with James’s investigators.

James began her investigation in 2019, after Michael Cohen, Trump’s former lawyer, testified before Congress about the Trump Organization’s alleged illegal business practices.

Earlier this month, Trump was forced to pay James’ office more than $110,000 as part of a deal to strike contempt of court over another subpoena to hand over financial documents in the investigation.

Trump and his attorney asserted that he did not have the records James requested and that he handed over everything else, while claiming his reasons were insufficient.

Ingoron ended up on James’ side, and Trump accused him of contempt of court and charged him with $10,000 for each day the documents were not shown.

Former President James, a Democrat, has previously been accused of interrogating him out of political hostility. But these accusations have not yet been confirmed in court.

The New York Court of Appeals said Thursday that James uncovered “large amounts of evidence” in its investigation.

The dossier also stated that Trump and the children “have not identified any company similarly involved that has not been investigated or any executives of such a company who have not been impeached.”

“Therefore, the appellants failed to demonstrate that they were treated differently than anyone in the same situation,” the report states.
